Terms of Service

The agreement between you and Avida LLC for using GuardYourName.

These terms govern your use of GuardYourName ("the service"), operated by Avida LLC ("we", "us"). By creating an account, registering a domain, or otherwise using the service, you ("you", "customer") agree to these terms. If you don't agree, please don't use the service.

Your account

You're responsible for keeping your account credentials safe and for everything that happens under your account. We strongly recommend enabling two-factor authentication (TOTP or passkey) — it's free and takes ~60 seconds at your profile.

You confirm that the information you provide (name, email, billing address, registrant contacts for any domain) is accurate. ICANN requires registrant data to be accurate; intentionally giving false information can cause your domain to be suspended or transferred away from your control.

What we sell

  • Domain registrations — we register domains on your behalf via OpenSRS or Namecheap. You become the registrant; we are the reseller. The domain is yours, and you can transfer it out at any time (we never charge a transfer-out fee).
  • Brand-protection bundles — packages of related domains chosen to protect a brand from common typo / TLD / extension squatting.
  • Hosting services — basic redirect / one-pager hosting for domains you've registered with us.
  • DNS management — record-level control for domains pointed at our nameservers.

Pricing and renewals

Domain prices are shown at checkout in US Dollars. Some TLDs are "premium" — the registrar surfaces an above-baseline price; we display it before checkout, so there are no surprise charges. Renewal prices may differ from the first-year price (e.g. promotional pricing is common at the registrar level); the renewal price you'll see at the time of renewal is the registrar's current rate plus our standard markup.

Recurring services (subscriptions, hosting bundles) renew automatically using the payment method on file. We email you a renewal reminder 7 days before the auto-charge runs so you can update or cancel without surprise.

Refunds

Domain registrations are non-refundable once the registrar has processed the transaction — that's a registry-level rule, not a us-level rule, and applies industry-wide. We honor refunds for registrations that fail on our side before reaching the registrar. We will work with you in good faith on edge cases (registration succeeded but the wrong domain was registered, etc.) — email support@guardyourname.com.

Recurring service subscriptions can be canceled at any time; you keep access until the end of the paid period. We don't pro-rate refunds for the portion of the period you don't use unless you ask and have a sympathetic reason — we're not interested in nickel-and-diming.

Acceptable use

Don't use the service to:

  • Register domains for phishing, malware distribution, or impersonation of a brand you don't own.
  • Send unsolicited bulk email (spam) from a domain you registered with us.
  • Host content that's illegal in the United States.
  • Attack, probe, or attempt to compromise our infrastructure (or anyone else's via our infrastructure).
  • Resell our service without a separate written agreement.

We reserve the right to suspend or terminate accounts that violate this policy, with refund of any prepaid service fees that aren't related to the violation.

Service availability

We work hard to keep the service running but we don't guarantee uninterrupted availability. The service is provided "as is" without warranty of any kind. We're not liable for indirect, incidental, or consequential damages arising from your use of the service. To the extent permitted by law, our total liability under these terms is limited to the amount you paid us in the 12 months prior to the claim.

Where you're a consumer in a jurisdiction whose law gives you mandatory rights that conflict with the above (UK Consumer Rights Act, EU consumer protection law, etc.), those rights take precedence — the disclaimer is reduced to whatever is permitted by your local law.

Termination

You can delete your account at any time. When you do, we erase your personal data per the retention schedule in the privacy policy — order shells (totals, payment IDs, registrar order IDs) are kept for accounting; personal data inside them is erased.

We can terminate or suspend your account if you breach these terms. We'll generally try to contact you first to give you a chance to fix the breach, except in cases involving security or legal urgency.

Governing law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Disputes arising under these terms will be resolved in the state or federal courts located in Brevard County, Florida — except where mandatory consumer-protection law in your jurisdiction provides you the right to bring a claim in your local courts.

Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top reflects the date of the most recent material change. For meaningful changes (more than typo fixes), we'll email customers at least 15 days before the new terms take effect, and your continued use of the service after the effective date constitutes acceptance.
